Travel and Contract Terms and Conditions

Dear guests and clients,

Please read the following travel and contract terms and conditions carefully. They rule the contractual relationship between you and us, the Wirtschaftsförderungsgesellschaft für die Stadt Worms mbH, Geschäftsbereich Tourismus (hereafter tour operator). Booking a travel with the tour operator, you acknowledge the following general travel terms and conditions for the tour operator’s package offers.

1 Services

1.1 All prices are final prices inclusive of all associated costs unless stated otherwise in the tour offer. Prices are per person.

1.2 The scope of services to be provided arises from the offer specified in the brochure and from the relevant specifications in the travel confirmation.

1.3 Side agreements extending the scope of services are binding only when confirmed in writing by the tour operator. Services that have not been called on cannot be reimbursed by the tour operator.

1.4 Amendments to specific travel services after the contract is concluded are permissible unless they are not substantial and do not interfere with the overall package of the travel booked. Under certain conditions, the tour operator will offer you a change in booking or a travel cancellation without charge.

2 Contract Formation

2.1 On booking a travel, you offer the formation of the travel contract to the travel operator. Putting his/her signature to the travel booking form or defraying the travel costs, the applicant enters in all contractual obligations and is held liable for the participants for whom he/she booked.

2.2 A travel contract results as soon as tour operator has confirmed in writing the booking with the services booked by the applicant, especially as to the travel price.

3 Payment

3.1 The travel price is payable ten days at the latest after the tour operator has confirmed the booking.

3.2 After the travel price has been paid, the applicant will be sent the full travel documents by the tour operator.

3.3 Last-minute bookings will be made possible upon availability. Payment in this case has to be made according to the provisions of the tour operator, at the latest upon arrival at Tourist Information Worms.

3.4 To secure clients’ funds, the tour operator has covered insolvency insurance with Touristik-Versicherungs GmbH (tourVERS). Applicants will find a certificate of this insurance as an attachment to the travel confirmation.

4 Cancellation on the Part of the Client

4.1 The client can at any time before the start of the journey cancel the travel by sending a notice of repudiation of contract by registered mail to the tour operator.

4.2 When the client cancels a travel, the tour operator is entitled to claim appropriate refund for the travel arrangements made and other relevant expenditures. Depending on the date of receipt of the notice of repudiation of contract, the following rates will be charged (in per cent of the booked overall package):

Standard cancellation fees

≥30 days before the start of the travel: 20% of the travel price;
29–22 days before the start of the travel: 25% of the travel price;
21–15 days before the start of the travel: 35% of the travel price;
14–8 days before the start of the travel: 50% of the travel price;
7 days–1 day before the start of the travel: 65% of the travel price;
≤1 day of the start of the travel / no start of the travel: 80% of the travel price.

Fees for special packages or Nibelungenfestspiele arrangements

≥30 days before the start of the travel: 20% of the travel price;
29–22 days before the start of the travel: 35% of the travel price;
21–15 days before the start of the travel: 50% of the travel price;
14–8 days before the start of the travel: 60% of the travel price;
7 days–1 day before the start of the travel: 75% of the travel price;
≤1 day of the start of the travel / no start of the travel: 100% of the travel price.

4.3 The cancellation fee is due and payable immediately.

4.4 Rebooking to a different date is possible only after a prior cancellation of the current travel contract. The fee for rebooking is €20.

5 Liability

5.1 The tour operator’s liability amount for damages is limited to the triple travel price unless the damage of the traveller was caused intentionally or recklessly by the tour operator. This does not apply for physical injuries. The limitation also applies if the tour operator is held liable for damages of the traveller caused solely by the fault of a service provider.

5.2 The maximum liability amounts are per traveller and travel.

5.3 The tour operator is not liable for external services negotiated in addition to the scope of services included in the travel package.

5.4 On booking a Nibelungenfestspiele arrangement, the client is aware that in the case of open-air events, compensation claims due to unfavourable weather are excluded. As for the refund of entrance fees, the jurisdiction as customary in practice will be referred to. As a rule, the entrance fee will not be refunded when the event is called off (not interrupted) due to unfavourable weather (rain, storm). If an event is cancelled beforehand, the client will—with the organiser consenting—on presentation of the ticket be refunded the entrance fee by the tour operator within two weeks. The refunded fees are equivalent to the official entrance fees of categories 1—3 determined for the respective season.

5.5 For the contract formation, the client’s travel agency only acts as a negotiator. After the travel has been finished, the agency is not entitled to file warranty or compensation claims on behalf of the traveller.

6 Legal Domicile

For all lawsuits resulting from the travel contract, only the City of Worms is determined as legal domicile.

General

The invalidity of one of the provisions of the travel contract does not imply the invalidity of the whole travel contract. The same applies for these travel terms and conditions. It is recommended to cover travel cancellation insurance, travel insurance and luggage insurance. In the case of a lawsuit, only the German version of these terms and conditions are valid.
